Overview: Zoning By-law Amendment

The Township of Terrace Bay will be holding a public meeting on August 7, 2018, regarding an amendment to regulate the parking and storing of recreational vehicles, boats, quads, snowmobiles and utility trailers in the Low Density Residential and Multiple Residential (MR) Zones.

 

BACKGROUND

An Ad Hoc committee was formed in 2017 to begin a review of existing bylaws and practices

The committee concluded that the new Zoning Bylaw was too restrictive with respect to regulating recreational vehicle storage in the residential zone.

The existing bylaw stipulates:

A maximum of one trailer, camper, recreational vehicle, motor home, boat or skidoo may be stored when not licensed and/or not in season, in any Residential zone, where a dwelling is in existence on the same lot, provided that such vehicle shall not be stored in a required front yard…”(Sec. 2.24.1)

“A recreational vehicle that is licensed, in season, and in regular use or an boat trailer, skidoo trailer or any other such vehicle may be parked in any rear or side yard, or may be parked in any front yard provided that the area used for parking is not less than 3.0 metres from a side lot line, and the entire vehicle can be parked on the lot without overhang onto the public road allowance..”(Sec. 2.24.2)

Since then, the committee has been consulting and engaging through various channels including:

  • Presentation/booth at the 2017 fall fair
  • Conducted a survey in late fall of 2017
  • Held an Open House on October 18, 2017
  • Updated Council in May 2018
  • Held a Public Consultation May 30, 2018

 

CURRENTLY

Following input from the public, it has been determined that a Zoning Bylaw Amendment is warranted regarding the storage of recreational equipment.

The amendment proposes:

  • Increasing the amount of rec. equipment from a maximum of one (1) to a maximum of three (3)
  • Allowing multiple vehicles stored on a trailer to count as one (1) vehicle
  • Clarifying the in-season and out-of-season periods
  • Allowing a trailer to be setup in a residential front yard or driveway to temporarily be used for accommodation (visiting family, mill shutdowns).

Therefore the Township of Terrace Bay will be holding a public meeting under Section 34 of the Planning Act to consider an amendment to By-law 10-2016, the comprehensive zoning by-law of the Township of Terrace Bay.

The meeting will be held on Tuesday, August 7, 2018 at 6:00 pm at the Municipal Office, 1 Selkirk Avenue, Terrace Bay.

If you wish to provide comment either oral or written on the proposed changes to the Zoning Bylaw you are encouraged to do so at the meeting for Council’s consideration. If you are unable to attend the meeting, you may provide written input by contacting the Clerk’s office, prior to the meeting.

TAKE NOTICE that if you wish to be notified of the decision of the Township of Terrace Bay on the proposed zoning by-law amendment, you must make a written request to the Clerk of the Municipality at the address below.

If a person or public body would otherwise have an ability to appeal the decision of the Council of the Township of Terrace Bay to the Local Planning Appeal Tribunal but the person or public body does not make oral submissions at the public meeting or make written submissions to the Township of Terrace Bay before the by-law is passed, the person or public body is not entitled to appeal the decision.

If a person or public body does not make oral submissions at the public meeting, or make written submissions to the Township of Terrace Bay before the by-law is passed, the person or public body may not be added as a party to the hearing of an appeal before the Tribunal, unless in the opinion of the Tribunal, there are reasonable grounds to do so.
